Dual agents work for the buyer and seller in the same transaction. Dual agency is not legal in Texas but brokerages have devised a work-around that neither benefits the seller or the buyer. If a Texas Realtor wants to sell a client's Sun City house to one of their buyers, a third party within their office can be appointed to handle negotiations for either of the parties. The broker is unquestionably the winner in this situation.
Real estate Buyer's agents work for traditional real estate companies such as Re/Max, Century 21, Keller Williams, etc. in which both buyers and sellers are represented. These brokerages offer incentives and pressure their agents to sell in-house listings. These Sun City agents really do not work for the buyer because the primary fiduciary duty of the brokerage is to the seller. They are not an Exclusive Buyer Agency.
Exclusive buyers agents represent only buyers 100% of the time, not a seller one day and a buyer the next. They work for companies that never take listings and the client's negotiating position is never jeopardized by a conflict of interest. An Exclusive Buyer Agent protects your rights, helps you buy the home you choose, and negotiates the best price and terms for you. The commission fee typically is paid from the seller's proceeds but may be negotiated.
